Terms of Service
Last updated: October 13, 2026
The short version
This summary is here to help you read the terms. It is not a substitute for them: the full Terms of Service below are the binding agreement.
- Puck Party is not affiliated with the NHL. We are not affiliated with, endorsed by or sponsored by the National Hockey League, the NHL Players’ Association or any NHL club. Their names and marks belong to them.
- It’s free, and there’s no money in it. Puck Party is not gambling. There is nothing to deposit, nothing to buy and no prize to win. You play for bragging rights.
- Game data can be late or wrong. Scores, stats and results come from public sources. We may correct picks, Hockey IQ and leaderboards when the data changes.
- You must be 13 or older. One account per person, and keep your email secure.
- Your name and photo are visible to other people. Don’t post anything you don’t want others to see, and don’t post anything offensive, unlawful or someone else’s.
- Play fair. No cheating, bots, fake accounts, harassment or attempts to break the Service. We can remove content and suspend or close accounts that break the rules.
- You can leave any time. Delete your account from the Account page.
- As is. We provide the Service as is, it may change or stop, and our liability to you is limited.
- Disputes. Colorado law applies. Most disputes go to individual arbitration instead of court, with no class actions. You can opt out of arbitration within 30 days.
- Your privacy is covered by our Privacy Policy.
1. Agreement to these terms
These Terms of Service (the “Terms”) are an agreement between you and Dandy Dev, Ltd., a Colorado company (“Puck Party,” “we,” “us” or “our”). They govern your use of the Puck Party app at puckparty.app, our emails, and any related features and services (together, the “Service”). By creating an account, signing in or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Our marketing website at puckparty.com is governed by its own Terms of Use.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, or under the age of majority where you live, you may use the Service only with the permission of a parent or legal guardian who agrees to these Terms on your behalf and is responsible for your use of the Service. You may not use the Service if we have previously closed your account for breaking these Terms. The Service is intended for people in the United States.
3. Your account
You must give us an email address that you control, and keep it secure, because anyone with access to it can sign in to your account. You may have only one account, and you may not share it, sell it or transfer it. You are responsible for all activity on your account. Tell us promptly at [email protected] if you believe someone has used your account without permission.
4. No affiliation with the NHL
Puck Party is an independent product. It is not affiliated with, endorsed by, sponsored by or approved by the National Hockey League, the National Hockey League Players’ Association, any NHL club, or any other league, team, player or broadcaster. NHL, the NHL Shield, and NHL club names, logos and marks are trademarks of the National Hockey League and its clubs. Player names and images identify the players only. All other trademarks belong to their respective owners. Any reference to them in the Service is for identification only and does not imply any endorsement.
5. Free; not gambling; no prizes
The Service is free. Puck Party is a game played for fun and bragging rights. It is not gambling, sports betting, fantasy sports for prizes, or a contest or sweepstakes of any kind. No purchase, deposit or payment is required or accepted, and no prize, money or other thing of value is awarded for picks, Hockey IQ, leaderboard positions, awards or anything else in the Service. Hockey IQ, records, awards and leaderboard positions have no monetary value and cannot be exchanged for anything. Nothing in the Service is an offer or solicitation to place a wager, and nothing in the Service is betting, financial or other professional advice. You agree not to use the Service, or anything in it, as the basis of any wager, prize or payment.
6. Game data, results and corrections
The Service uses information about NHL games, clubs, players and statistics drawn from publicly available sources and from our own calculations. This information may be delayed, incomplete, inaccurate or out of date, and it may change after the fact, for example when a goal or an assist is reassigned. Facts and clues in the Service describe past results and are not predictions.
We decide how questions are set, when picks lock, and how picks are graded. We may correct, regrade, void or remove questions, picks, Hockey IQ, records, awards and leaderboard positions at any time, including after a game has ended, to fix errors, reflect changed game data, or address cheating or abuse. Our determinations about questions, picks and results are final. Late picks, picks made after a lock and picks affected by a technical problem may not count.
7. Teams, parties and other people
Teams are groups of people who play together. The person who leads a team may invite and manage members, and teams have size limits. We are not responsible for the conduct of other people using the Service, whether on your teams or not. You can block people and leave teams at any time. Your interactions with other people are between you and them.
8. Your content
“Your Content” means anything you submit to the Service, such as your display name, profile photo, team names, and any other text, images or responses. You keep any rights you have in Your Content.
You grant Puck Party a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to host, store, reproduce, modify (for example, to resize or format it), display and distribute Your Content, in connection with operating, providing, improving and promoting the Service. This license lasts until Your Content is deleted from the Service, except that it continues for content that other people have interacted with and that remains in the Service as described in our Privacy Policy, and for copies in backups for a limited period.
You are responsible for Your Content. You confirm that you have the rights to submit it, and that it does not violate these Terms, the law, or anyone else’s rights, including intellectual-property, privacy and publicity rights. Your display name and profile photo are visible to other people using the Service, so do not use anything you want to keep private.
We may review, refuse, edit, hide or remove any of Your Content at any time and for any reason, including if we believe it violates these Terms. We are not obligated to monitor content, and we are not responsible for content submitted by other people.
9. Acceptable use
You agree not to, and not to help anyone else to:
- use the Service in violation of any law or of anyone else’s rights;
- post content that is unlawful, harassing, threatening, hateful, sexually explicit, defamatory, or that impersonates any person, club or organization, or uses a name or photo you do not have the right to use;
- harass, bully, threaten or abuse anyone, or invite or contact people who do not want to hear from you;
- cheat or manipulate results, picks, Hockey IQ or leaderboards, including by creating multiple or fake accounts, coordinating accounts, using bots, scripts or automation, or exploiting bugs;
- access the Service or its data by any means other than the interfaces we provide, or scrape, crawl or harvest the Service or information about other people;
- probe, scan or test the vulnerability of the Service, or breach or get around any security, rate limit or access control, unless we have given you written permission;
- interfere with or disrupt the Service, including with malware or by overloading it;
- copy, modify, distribute, sell, rent or create derivative works from the Service, or reverse engineer it, except as the law expressly allows;
- use the Service for any commercial purpose, including advertising or soliciting, without our permission; or
- use the Service or its content to train, develop or improve machine-learning or artificial-intelligence models without our written permission.
If you find a security problem, please report it to [email protected] and do not use or share it.
10. Our content and intellectual property
The Service and its content, other than Your Content and content owned by others, including its software, designs, text, graphics, questions, facts and logos, are owned by Puck Party or its licensors and are protected by intellectual-property laws. “Puck Party” and our logos are our trademarks. Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable and revocable license to use the Service for your own non-commercial entertainment. We reserve all rights not expressly granted.
11. Feedback
If you send us ideas, suggestions or other feedback, you agree that we may use it for any purpose without restriction or compensation to you. We have no obligation to keep feedback confidential or to act on it.
12. Third-party services
The Service relies on and may link to services that we do not control, such as Google sign-in and NHL image servers. We are not responsible for their content, availability, policies or practices, and your use of them is governed by their own terms.
13. Changes to the Service and these Terms
We may change, add, remove, suspend or discontinue any part of the Service, including any question, game mode, feature, team limit or scoring rule, at any time, with or without notice. We may also update these Terms. When we do, we will change the “Last updated” date above, and if a change is material, we will give additional notice, for example in the Service or by email. Changes take effect when posted. Your continued use of the Service after changes take effect means you accept them. Changes to the dispute-resolution section do not apply to a dispute that you or we had already notified the other of before the change was posted.
14. Suspension and termination
You may stop using the Service and delete your account at any time from the Account page. We may suspend, restrict or close your account, or remove any of Your Content, at any time, with or without notice, if we believe you have broken these Terms or the law, if your use creates risk or harm for us or others, or if we stop offering the Service. When your account is closed, your right to use the Service ends, and your information is handled as described in our Privacy Policy. Sections that by their nature should survive termination will survive, including those on Your Content (to the extent described), intellectual property, feedback, disclaimers, limitation of liability, indemnification, dispute resolution and governing law.
15. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT AND INFORMATION IN IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. PUCK PARTY DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, THAT YOUR PICKS, RESULTS OR CONTENT WILL BE SAVED OR PRESERVED, OR THAT ANY INFORMATION IN THE SERVICE, INCLUDING GAME AND STATISTICAL INFORMATION, IS ACCURATE, COMPLETE OR CURRENT.
16. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL PUCK PARTY, ITS AFFILIATES, OR ITS OR THEIR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SUPPLIERS OR LICENSORS (THE “PUCK PARTY PARTIES”) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, CONTENT, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICE, YOUR CONTENT, THE CONDUCT OF OTHER PEOPLE, OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF THE PUCK PARTY PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above may not apply to you. In that case, our liability is limited to the smallest amount the law allows.
17. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless the Puck Party Parties from and against any claims, liabilities, damages, losses and expenses, including reasonable attorneys’ fees, arising out of or relating to your use or misuse of the Service, Your Content, your violation of these Terms, or your violation of any law or of anyone else’s rights.
18. Dispute resolution and arbitration
Please read this section carefully. It affects your legal rights, including your right to go to court and to take part in a class action.
Informal resolution first. Before starting an arbitration or court case, you and we each agree to try to resolve the dispute informally for at least 30 days. To start, send a written description of the dispute and the relief you want to [email protected] (or, if we start, we will email you at the address on your account).
Binding individual arbitration. If the dispute is not resolved informally, you and Puck Party agree that any dispute, claim or controversy arising out of or relating to the Service or these Terms (a “Dispute”) will be resolved by final and binding arbitration on an individual basis, administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. The arbitrator, and not a court, decides all questions about whether a Dispute must be arbitrated, except that a court decides questions about the class-action waiver below. The arbitration will be held remotely or in the county where you live, unless you and we agree otherwise. Payment of fees is governed by the AAA’s rules. The Federal Arbitration Act governs this section.
Exceptions. Either party may bring an individual claim in small-claims court if it qualifies. Either party may also ask a court for an injunction or other equitable relief to stop the infringement or misuse of intellectual-property rights or unauthorized access to the Service.
No class actions. YOU AND PUCK PARTY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may award relief only to the individual party seeking it. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) must be severed from the arbitration and brought in court.
30-day opt-out. You may opt out of this arbitration agreement by emailing [email protected] within 30 days after you first agree to these Terms, with the subject line “Arbitration opt-out” and your name and the email address on your account. Opting out does not affect any other part of these Terms.
Time limit. To the extent permitted by law, any Dispute must be started within one year after it arose; otherwise it is permanently barred.
19. Governing law and venue
These Terms and any Dispute are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs the arbitration section. Any Dispute that is not subject to arbitration will be brought only in the state or federal courts located in Colorado, and you and we consent to their personal jurisdiction and venue.
20. General
These Terms, together with our Privacy Policy and any rules shown in the Service, are the entire agreement between you and Puck Party about the Service and replace any prior agreements on that subject. If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permissible and the rest of these Terms will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign or transfer these Terms without our prior written consent; we may assign them without restriction, including in connection with a merger, acquisition or sale of assets. Headings are for convenience only. “Including” means “including without limitation.” We are not liable for any failure or delay caused by events beyond our reasonable control. We may send you notices by email to the address on your account or in the Service.
